Affidavit of Entrance Program

This packet has all the materials you will need to become part of this important new program.

Enclosed please find a copy of Wilmington City Code §36-6, which authorizes the Affidavit of Entrance program, and an Affidavit of Entrance for you to sign. An affidavit is a signed and sworn statement. By signing and notarizing an affidavit, you state that you understand and agree to the statements contained in the document.

With your cooperation, the Wilmington Police Department will now have the ability to better service the City, your community, your neighborhood and you. You are encouraged to read the ordinance and the affidavit carefully. Because this is a legal document which affects important rights, you may wish to contact an attorney before signing your affidavit.

As part of this program, you should expect that Wilmington Police Officers may occasionally enter places like your yard or your porch. If your property is a multiple family dwelling, you should expect that Wilmington Police Officers may occasionally enter the common elements or areas of your building. You will be provided with a sign which warns individuals that you are part of this program. Of course, the decision to display this sign is entirely up to you.

The City of Wilmington is committed to preventing crime, but also equally committed to protecting and preserving important Constitutional Rights. This program is directed at allowing the police access to your property with your permission, not decreasing constitutional rights. Accordingly, Wilmington Police Officers will not enter into your home or into individual apartments in a multi-family dwelling unless there is legal justification for such action. The Affidavit you are about to sign and the ordinance which authorizes this program, does not, by itself, allow this type of intrusion. Additionally, Wilmington Police Officers cannot, and will not, arrest an individual merely because they are not listed in your affidavit. Of course, the laws of the State and City will be vigorously enforced at all times. As a member of this program, that protection is brought closer to you.
