MINIMUM QUALIFICATIONS: A Senior Assistant City Solicitor must be an attorney with three or more years of experience in the practice of law before the Supreme Court of Delaware or equivalent experience in the practice of law in another state to the extent permitted by the Rules of the Supreme Court of the State of Delaware. This individual must consistently demonstrate sound decision-making, problem solving and communication skills. He or she must also possess and convey judgment and integrity.
REQUIREMENTS(S): Must pass a criminal background investigation, pre-employment physical, and drug test; and, have the ability to work a flexible schedule.
NATURE OF WORK PERFORMED: A Senior Assistant City Solicitor is an executive and professional position which directly reports to the City Solicitor. This individual has recognized subject matter expertise in one or more of the following areas: labor and employment; transactional litigation management; economic development and City Council support. He/she is able to independently handle cases or matters within one or more of those areas of practice.
EXAMPLES OF WORK PERFORMED: The Senior Assistant City Solicitor may, depending on his or her area of subject matter expertise: develop and execute labor and employment negotiation strategies; develop and implement training on certain policies; negotiate, review and draft certain contracts and transactions; develop and implement certain litigation strategies; implement legal strategies supporting economic development initiatives; and ensure the delivery of necessary legal support and services to City Council. Specifically, and depending on his/her area(s) of expertise, the Senior Assistant City Solicitor represents the City in various legal proceedings, including but not limited to trials, appeals, mediations, and arbitrations. Researches and authors legal pleadings and briefs. Conducts settlement negotiations. Plans trial and appeal strategies. Monitors legal cases assigned to outside counsel. Investigates legal complaints and alleged violations of federal, state, and local law. Prosecutes violations of the City's Code of Conduct before the City Ethics Commission. Prosecutes misdemeanor violations of the City's Housing, Building, Sanitation, and Fire Codes in the Justice of the Peace Courts. Enforces nuisance laws through court action. Reviews all City contracts and requests for waivers of the City Charter bidding requirements. Represents the City in all bidding disputes. Serves as legal advisor for City boards and commissions. Prepares or assists in preparing ordinances and resolutions introduced to City Council, attends Council meetings, and coordinates publication of City Code supplements. Works with the City’s Claims Manager to review claims, as needed. Works with the City's Risk Manager to identify and manage liability risks. Works with other departments to provide up-to-date training and policies regarding legal matters. Works with other departments to address neighborhood issues. Reviews legal publications and periodicals to keep apprised of current legal developments. Performs all related work as required.
REQUIRED KNOWLEDGE, SKILLS, AND ABILITIES: Thorough knowledge of personnel management principles and practices. Thorough knowledge of the many and varied areas of law which affect the City, particularly constitutional and civil rights law, administrative law, municipal corporation law, and criminal law. Thorough knowledge of civil and criminal procedures. Superior advocacy skills, including excellent oral and written communication skills. Superior interpersonal skills. Ability to manage multiple projects and meet established deadlines. Ability to establish and maintain effective working relationships. Ability to manage and resolve conflicts. Strong work ethic. Ability to develop, socialized and execute complex coordinated and integrated strategic priorities. Demonstrate initiative and enterprise leadership. Good knowledge of Microsoft Office, WordPerfect, and Lexis Nexis.
RESIDENCY: City residency required within six months of employment.
